Yes, a charity can own a property. However, it must be used for the charitable purposes outlined in the organisation’s governing documents. A charity may hold the building in its own name if it is incorporated or through trustees if it is unincorporated.
Charities can be eligible for tax relief when they use their property for charitable activities. Exemptions may include Business Rates and Stamp Duty Land Tax.
Charities can rent out premises, but all income should support the organisation’s objectives. If the proceeds are not benefitting the not-for-profit directly, trustees must ensure that lease agreements align with charity law.
Section 36 of the Charities Act 2011 governs the sale, lease or transfer of charity land. Trustees or those handling the transfer must obtain a qualified surveyor’s report, advertise the space appropriately and ensure the sale is in the charity’s best interests.
